1) The Phoenix could kill them all with a flick of her mind, but Jean hasn't merged with the Phoenix Force yet and therefore hasn't had her power level "upgraded" yet.
2) Of course no one ever dies. For one thing, none of the parties involved are trying to kill each other, just assert their goals over the goals of the others. Secondly, the show is primarily aimed at 'tweens, so of course the writers are going to avoid deaths where possible.
3) Same social time period and intended primary audience. You really expect different?
4) Duh. That was the original setting for the X-Men back in the '60s, and going back to the setting's roots was one of the ideas the writers wanted to explore.
5) How, exactly, are their powers being misrepresented? The power types are correct for the characters and have about the right outputs and inconsistancies for people that are still just discovering what they can do.
6) What does Disney have to do with any argument you could have for this show? They had no involvement in making it. The scripting and concept work came straight from Marvel and the animation and production work was done by Warner Bros. The closest connection Disney has to the whole thing is that the series once ran on the Disney XD network.
If you want to complain about something, then go ahead and complain. Just please find something worth complaining about first.
