The first two gave up their rights. The first guy ran, that's a no brain-er, and the second confessed. The thing is, cops do not have to tell you that if you answer this question you are waiving your 4th or 5th amendment. That second dude should have said immediately, "I do not consent to a search". Cops must have tangible evidence for probable cause, and last time i checked, driving around is not enough evidence for a warrant-less search, now the cop did say that he smelled marijuana, that is tangible evidence. But hey, if they want to spill the beans and confess to anything that they are doing, be my guest. I just think that opens the door for the police to abuse their power, if you just confess all the time, you might confess or be led to waive your rights, to something that you didn't do. And when the cops ask me why I don't consent to a search, its real simple, they will not put back what they found in the right order. I have my glove compartment and center dash organized so I can find my stuff. When they get their hands on it, they never put it back the way they took it out. It took me hours to find my "buy ten get one free" card because he put it on top, and it fell behind the dash, when the cop closed the compartment.
